Information: Although every effort is made by Target Markets (TM), its agents, associates or employees to verify information given in their web site, brochures, and promotional material, it must be clearly understood that such information does not form any part of any contract or offer. Any intending purchaser of property or land or any other such purchase must satisfy themselves as to the correctness of any information provided by the company via the website or email and properties and land are sold subject to contract between the buyer and the seller.
Details:TM, its agents, associates or employees make every effort to keep up to date the information stated in its web site, brochures and other promotional material, but it cannot guarantee that particular a property will still be available for sale when prospective purchasers enquire. TM reserves the right to make changes to the information and content of our website at any time without notice.
Availability: TM its agents, associates or employees does not accept any liability to interested purchasers resulting from their inability to view properties in which they may be interested due to the fact that the properties may no longer be available for sale, or due to revision of purchase prices, or due to unforeseen circumstances.
Services: All related services offered, such as finance, mortgages, insurance, Currency exchange, legal and tax advice, removals and any other service from a third party – are recommended in good faith only and all agreements and contracts with such parties for such services are entirely the responsibility of the buyer/user and service provider and not the liability or responsibility of TM.
Currency exchange Rates: Be aware that currency fluctuations can greatly affect the price you pay in sterling for a property when you come to pay for it. We advise you to keep this in mind and seek professional help when transferring money abroad. Note also that properties are often listed in their ‘local’ currency and therefore a sterling price is often only a guide.
Business liability: TM its agents, associates or employees operate as an introducing and sourcing agent to assist interested persons in finding and purchasing property and/or land investments. Target Markets is not liable for any loss which they may incur for any reason whatsoever resulting from their interest in purchasing, attempted purchase or actual purchase of a property overseas.
Measurements, tenure & usage: Land, property and room sizes provided by TM its agents, associates or employee’s web site, brochure or any promotional material are subject to change. It remains the responsibility of the purchasers to satisfy themselves as to the correctness of such information. It remains the responsibility of purchasers of plots of land or any property to acquire/check all necessary planning consents and licences. Title and tenure is also the liability of the buyer, lawyer and seller and TM recommend that the services of a professional are employed when purchasing any property, land or lease of any kind.
Viewing & Travel: All contracts for transport by rail, sea, air or on land, for accommodation, board and lodging, for legal and estate agency services, or for any other associated services shall be deemed to be contracts between the person/s travelling and the service provider. TM its agents, associates or employees makes every endeavour to recommend only reliable and reputable providers of transport, accommodation, legal, estate agency and other services and shall not be held responsible or liable for any loss or damage resulting from such recommendations.
In the main, TM, their agents, associates or employees are paid a percentage of the builders, sellers. agents or developer’s profit/fees or selling price and this is generally part of the allocated budget for marketing and sales and therefore the buyer does not pay more for a property as a result of buying via TM. Therefore, in effect, a client receives a free service from TM including the advice, support, search and to utilise our place in the market to source investment property. There are some circumstances where a sales administration and sourcing fee is charged to the client by Target Markets – where there are low or no commissions available via the sellers. In such cases these fees will be shown on the reservation document as ‘Reservation Fees’ and are set prior to your reservation of the property and will be clearly communicated to you. Property reservation deposits and reservation fees are non-refundable unless explicitly noted on the property reservation contract. If a property reservation payment is refundable in full or in part it will be noted on the reservation contract along with any additional terms and conditions relating to said payment. If you are in any doubt please contact us for confirmation in writing prior to reserving your chosen property. If there are no further terms on the property reservation contract relating to the reservation payment, please note that the payment is non-refundable should you cancel your property reservation.
Associated company’s actions: TM its agents, associates or employees shall not be held liable or responsible for the actions of other persons or companies with which it may be associated or have connections with. Building time on new property: Whilst every effort is made by TM its agents, associates or employees to give accurate information to purchasers of “off plan” properties as to the building time of such properties it must be clearly understood that purchase contracts are with the relevant construction company and not with TM its agents, associates or employees. Estimated building times are given by the relevant construction company and it should be clearly understood that delays or changes may occur. TM its agents, associates or employees accept no responsibility for any such delays or changes.
Access and use of the TM websites and content: All materials, logos, pictures and content on Target-markets.co.uk and other owned websites within our group are the sole ownership of TM and cannot be used by other parties in any way unless by written consent is provided.
Post agreement to purchase queries: TM its agents, associates or employees operate act as an introducing agency to assist interested persons in finding and purchasing properties from a range of developers, agents and associates. All future customer queries regarding the property purchased are dealt with by the developer, seller or agent who issues your contract. All legal queries should be directed to the lawyer you have appointed and not TM. its agents, associates or employees.
Data Policy: When registering with TM for the purpose of finding a property, personal details such as name, address, e-mail and phone number will be required. This data may be passed on/shared with our associated companies and developers and this is essential in assisting a customer with their purchase or assisting them to find a suitable property to purchase. Your information will never be sold to any party for any purpose. Your information will only be used by TM in relation to your purchase. Our partners involved in assisting you with your purchase may add your details to their own data-base for the purpose of progressing your purchase and to offer corresponding services. If you do not wish for your details to be shared in this way, please inform us in writing prior to reserving your chosen property.
Additional services: TM its agents, associates or employees do not organise NIE numbers, bank accounts, mortgages, power of attorney, immigration advice, etc…for clients. It is up to the client themselves to organise all of these, either with their appointed lawyer or any other competent advisor.
Disclaimer: TM disclaims to the maximum extent permitted by law all representations, warranties (express or implied) regarding products, services, quantities, pricing, information, published on our web site, in our brochures or other documents or in any other form or location. Data is constantly updated and therefore is not necessarily accurate, current or complete. Provision of the products, services, information is on an “as is” basis. In particular the terms and conditions herein shall constitute the entire agreement between you and TM and any modification to these conditions will be binding only if it is evidenced in writing signed by a director of the company and such evidence contains specific reference to those conditions being modified. We reserve the right to decline any order, registration or subscription without giving any reason.
Purchaser’s Responsibility: All property details are presented in good-faith but do not form part of any purchase contract. It is the responsibility of the purchaser to satisfy themselves that all of the property details provided are correct and all properties are sold subject to contract. It is the purchaser’s responsibility to obtain any legal and financial advice that they may require before proceeding with any property reservation or purchase. TM can introduce you to solicitors and financial advisors and tax consultants but please be advised that these are recommendations made in good-faith and that any disputes that may arise are between the purchaser and the service provider and are not the responsibility of TM. You must proceed with your purchase in a timely manner and remain in contact with us and/or the sellers/developers. If for any reason you will be out of contact via email or telephone for more than 4 weeks please inform us immediately via email to avoid any possibility of cancellation of the reservation/purchase.
Claims and Guarantees: You agree that all photos and figures quoted are for illustrative purposes only and that it is up to you to conduct sufficient due diligence and research into the property including seeking competent authority prior to making any financial decision, this includes undertaking a property valuation, researching the area and market rent. We make no claims as to the specification of the finished property. You will need to refer to the builder’s specification sheet for the individual plots or to any details provided by any seller. We have given you no guarantees. You are aware that property values and rents can go up as well as down and that if you do not keep up payments on loans or mortgages secured on your property it may be repossessed.
TM, its employees, contractors, successors and assigns do not accept any liability for any investment decisions or purchase decision made on the basis of, arising out of, or in any way related to, the use of information contained in our marketing publications and emails. The information and services provided by TM its employees, contractors successors and assigns does not constitute legal, financial, investment or tax advice and should not be taken as such.
Disputes:Target Markets Ltd is a member of the AIPP ( Association of International Property Professionals) and adheres to its code of conduct which can be found by visiting http://www.aipp.org.uk/industry/code-of-conduct/ In the unlikely even of a dispute please write to us in the first instance to allow us the opportunity to resolve the matter with you directly. If you are unhappy with our final response please contact the AIPP who will be able to assist you as to the next steps with regards resolving any dispute via their Disputes Resolution Process. A copy of this process is available upon request.
Content: Except as expressly provided in this Agreement, all of the content on this site is the property of TM and is protected by UK and international copyright laws. “Content” means any information, mode of expression, or other material and services found on the www.target-markest.co.uk website, printed matter or any other form of communication fromTM. This includes discussion boards, chat, software, our writings, graphics and any and all other features found on the site.
Force Majeure: We shall be under no liability if we shall be unable to carry out any provision of the contract for any reason beyond our control including (without limiting the foregoing) Act of God, legislation, war, fire, flood, drought, failure of power of supply, lock-out, strike or other action taken by employees in contemplation or furtherance of a dispute or owing to any inability to procure materials required for the performance of the contract. Law: These conditions and all other express terms of the contract shall be governed and construed in accordance with the laws of England.
